Confidential Arbitration Proceedings

Tiger Woods initiated confidential arbitration proceedings in response to Herman’s lawsuit to prove that she had no legal claim to reside in his home and was not entitled to any financial compensation.1

Woods argued that both parties had signed a Non-Disclosure Agreement (NDA), which meant that any disputes must be resolved in confidential arbitration rather than a public court.

Sexual Harassment Allegations

Herman claimed that the dispute involved sexual harassment and that the NDA was invalid due to the newly passed Speak Out Act, a federal law that came into effect on January 26.

However, her attorney did not initially make any sexual harassment allegations in the lawsuit, and merely cited the new law.

Latest Developments

In order to avoid going back into private arbitration, Herman needed to provide more details to the court about the sexual harassment allegations.

In the latest document submitted on Friday, the documents claimed that “The landlord made the availability of her housing conditional on her having sexual relationship with a co-tenant.

That conduct amounts to sexual harassment under federal and Florida fair housing laws.”

Tiger Woods has yet to respond to the latest allegations. His attorney, J.B. Murray, previously stated in court that there was no oral tenancy agreement between Woods and Herman, and that her sexual harassment claims were false.
